Promoter or ‘we’ or ‘us’:

Promotional Period:

Eligible Claimants:

Entry is only open to Australian permanent residents aged 18 years or older that have:

opened a LIVVIT account and purchased a LIVVIT product; and complied with the requirements under the ‘How to enter’ heading below.

How To Enter:

To enter, entrants must:  Take a photo that captures how they make wellness personal with LIVVIT;
Upload the photo to their Instagram page, tagging @livvit.health and #livvitcomp, including a caption about their health goal(s) and why they love LIVVIT; and  
Follow and continue to be following the Promoter's Instagram page @livvit.health (www.instagram.com/livvit.health) up until the time of prize determination.

Each entrant's privacy settings must be set to public so the Promoter can access their entry.

Entries must not appear to promote any goods or services other than those of the Promoter.

How winners will be selected:

This is a game of skill.  Chance plays no part in how a winner will be selected.

All valid entries will be reviewed and judged by the Promoter (or appointed judge/s) based on creativity, originality and applicability to the entry question and brand suitability.

Each month, the 2 entries judged to be the best will win a prize. The 2 Winners will be chosen on the first business day of each calendar month following the Start Date during the Promotional Period from the valid entries entered in the previous month (Winner).  Each monthly competition period closes 1 business day before the end of each calendar month. Any entries after this period will be considered in the following month.

The Promoter may judge additional reserve entries and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Winners). 

Winners will be notified via Instagram direct message to the Instagram account used for the entry and will also have their Instagram username announced on the Livvit Instagram story within 2 business days of determination.

Prizes:

There are 2 prizes available each month.  Each Winner is entitled to one prize.

Each prize is a 50% discount off a single bottle of Livvit Daily Personalised vitamins.  The  value of each prize at the Start Date is $20. For the avoidance of doubt, the discount is based upon the advertised price of a single bottle of Livvit Daily Personalised vitamins at the time the relevant Winner is selected. 

The total prize pool is $480.

Additional Conditions relating to prizes

No cash alternative to the prizes will be offered.  The prizes are not transferable or exchangeable. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in prize value.  Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of equivalent value without giving notice.  

By entering the Promotion, all entrants give express consent for their content (including all images and captions contained in any entry uploaded by the entrant) to be featured on the Promoter's social media in perpetuity (subject to any applicable law) and to be announced through the Promoter's Instagram story if selected as a winner.

Entry limits:

Entrants may enter as many times as they wish, however each entry must be based on a separate post and must be submitted separately in accordance with these Terms and Conditions.

Unclaimed prizes:

Prize claim date: By the time and date stated in the private message sent to winner/s. 

If a prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the winner can't be contacted (or a winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s. Any winner/s will be informed via private message to the Instagram account used for entry.  

By entering, each entrant agrees and acknowledges that they have read these Terms and Conditions (and Schedule above) and that accepting a prize in the Promotion is deemed to be acceptance of these Terms and Conditions.  Any capitalised terms used in these Terms and Conditions have the meaning given in the Schedule, unless stated otherwise.  

The Promotion commences on the Start Date and ends on the End Date (Promotional Period).  Entries must be received during the Promotional Period.  Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant.  Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of any entrant.

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities.  Entry is conditional on providing this information.

The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant.  Entrants should direct any request to access, update or correct information to the Promoter.  All entries become the property of the Promoter.  The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at www.sanofi.com.au.

The Privacy Policy also contains information on how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.  The Promoter will not disclose entrants' personal information to any entity outside of Australia.

Prize/s and all elements of prize/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, validity periods. The Promoter is not responsible for any dispute between an entrant and any person with whom an entrant chooses, or chooses not to, share a prize.

The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise.  Unless otherwise specified, prizes will only be delivered to addresses in Australia.

Entrants must not:

  tamper with the entry process; engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;
act in a disruptive, annoying, threatening, abusive or harassing manner;
do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion;
breach any law; or
behave in a way that is otherwise inappropriate.

Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion, or suspend or modify a prize.

The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence).  In the event that an entrant cannot provide suitable proof, the entrant will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible claims, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to claim a prize.  Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to receive a prize.  The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically claim repeatedly is prohibited and may render all claims submitted by that individual invalid.

Every entry must be an entrant's original work and not copied.  Each entrant warrants that their entry does not breach any third party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law). Entries must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity or language the Promoter deems offensive).

  Entrants must not include any other person in their entry unless they have consented to the photograph being submitted in this Promotion.  If the entry includes a child’s name or image, the entrant must be the parent or legal guardian of the child.  Entrants must ensure their entry does not contain any virus, malware or other malicious or inappropriate computer code or material.  Entrants acknowledge that their entry and their name may be made publicly available by the Promoter (in its absolute discretion) and will be accessible to the general public to view.

The Promoter may copy and amend entries and may use (or allow others to use) entries and any rights in relation to entries, to publicise this Promotion or for any other purpose.  These rights are perpetual, royalty free, world-wide, irrevocable and transferable.  For example, the Promoter may publish all or any part of an entry or any amended version of it.  The Promoter may also decide not to publish an entry, to cease publication of an entry, or to publish an edited entry.

By using and entering this Promotion on Instagram, entrants:
agree to comply with Instagram’s terms of use;
release Instagram from all claims based on, related to or arising from the Promotion; and
acknowledge and agree that this Promotion is in no way sponsored or endorsed by or affiliated with Instagram.

To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage or injury to any entrant resulting from entering or participating in this Promotion including arising from any comments made, or material published, by third parties about the entrant on any social media platform in connection with this Promotion.

The Promoter reserves the right to disqualify entries or prize claims in the event of non-compliance with these Terms and Conditions.  In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each claimant and no correspondence will be entered into. By entering, entrants request that their full address not be published.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

The Promoter accepts no responsibility for any tax implications and winners must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize. If for GST purposes this Promotion results in any supply being made for non-monetary consideration, winners must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
